In the twentieth century, two Nobel-Prize winning economists wrote two seemingly unrelated characterizations of the processes constraining human behavior. One, Ronald Coase, wrote a short article entitled The Nature of the Firm,1 in which he reduced all managerial decision-making to a fundamental choice between making the factors of production, or buying them. This article and the idea of the "make or buy" decision for which it has come to be known, have proven to be among the most seminal in the (...) history of financial economics and organizational behavior. The second economist, Friedrich Hayek, wrote what he thought to be a comprehensive treatment of the approach that ought to be taken to the generation of rules constraining human interaction. This voluminous work, Law, Legislation and Liberty, characterized the creation of legal rules as the product of either spontaneous or planned orders. Hayek argued that spontaneous orders like "law" were more efficient mechanisms for governing human behavior than planned orders like "legislation." 2 This thesis received a lukewarm reception generally, and virtually no reception at all in legal circles. This Article demonstrates that Coase and Hayek were actually making the same observation, albeit in different contexts. Hayek's conception of the two sources of order is, in fact, a more abstract application of Coase's "make or buy" decision. Had Hayek understood his characterization of legal processes to be a variant of Coase's "Theory of the Firm," his ideas may have received more traction. Lawyers, judges, and lawmakers may also have understood some of the implications of Hayek's thesis for constraining legal actors, as well as its applications in current debates on the scope of administrative agency authority, tort reform, or the use of legislative history in litigation. We sought to evaluate whether health care professionals’ viewpoints differed on the role of ethics committees and hospitals in the resolution of clinical ethical dilemmas based on practice location. We conducted a survey study from December 21, 2013 to March 15, 2014 of health care professionals at six hospitals. The survey consisted of eight clinical ethics cases followed by statements on whether there was a role for the ethics committee or hospital in their resolution, what that role might be and (...) case specific queries. Respondents used a 5-point Likert scale to express their degree of agreement with the premises posed. We used the ANOVA test to evaluate whether respondent views significantly varied based on practice location. 240 health care professionals completed the survey. Only three individual queries of 32 showed any significant response variations across practice locations. Overall, viewpoints did not vary across practice locations within question categories on whether the ethics committee or hospital had a role in case resolution, what that role might be and case specific queries. In this multicenter survey study, the viewpoints of health care professionals on the role of ethics committees or hospitals in the resolution of clinical ethics cases varied little based on practice location. The very title of Sidgwick’s great work is fascinating: the methods of ethics. We hear much—and persons a hundred years ago heard much—of the methods of science. But we hear very little of the methods of ethics. Is ethics a science? No, and Sidgwick never thought that it was. But he did think that the methods, or something of the spirit, of scientific investigation could be imported into ethical studies, with results which, though they would not necessarily be dramatic and (...) would certainly not be edifying, would nevertheless be worthwhile. Sidgwick himself characterized his work as “essentially an attempt to introduce precision of thought into a subject usually treated in a too loose and popular way”. “I have thought that the predominance in the minds of moralists of a desire to edify has impeded the real progress of ethical science; and that this would be benefited by an application to it of the same disinterested curiosity to which we chiefly owe the great discoveries of physics”. Objective Our objective was to evaluate whether those individuals with previous involvement with formal clinical ethics processes differ in their attitudes towards the resolution of prototypical clinical ethics cases than general health care professionals. We hypothesized that those individuals with previous participation in ethics consultation would have significantly different attitudes on the appropriate role of ethics committees in the assessment and resolution of clinical ethical dilemmas than those who have not. Methods We conducted a case-based survey of health care professionals (...) at six US hospitals. We administered the survey to health care professionals in a variety of clinical roles at each center and further sub-categorized these by respondents reporting or not reporting their membership on an ethics committee or participation as an ethics consultant/requestor of ethics consult services. Using the analysis of variance test, we present the variation in attitudes using a 5-point Likert scale with 95% confidence intervals and significance set at p ≤ 0.05. Results A total of 240 respondents completed the survey (response rate: 63.6%) from all six surveyed centers (128 respondents with involvement with ethics consultation, 112 respondents without). Health care professionals not previously involved with formal clinical ethics processes were less likely to view the ethics committee as having a role in resolving the presented clinical ethical dilemmas ( p = 0.01 for analysis of variance comparison). Conclusion In this multi-center survey study, health care providers without previous involvement with formal clinical ethics processes were less likely than those with previous involvement to support a role for ethics committees aiding in ethical case resolution. There are a number of different ways of teaching ethics, and there is ample room for a number of different ways of teaching ethics. I am sure that there is no one way that is right, but I am also sure that there are a number of ways, some of them in widespread use, that are wrong. It is wrong, for example, to teach ethics by simply presenting and discussing a number of ethical theories, in isolation from the actual or (...) imagined problems of morality that these theories were developed in response to. It is wrong, in other words, to present ethics as a series or collection of disembodied abstractions. It is also a mistake to attempt to teach ethics simply by presenting the history of the subject, because this still presents the subject as consisting in the unregulated combat of a number of rival theories, and from this one’s students can get no idea of what the problems are with which these theories were attempting to deal, or even whether they were all attempting to deal with the same problems. Yet this is better, if only because the early and important moral philosophers almost all had a very lively sense of what the problems were with which they were attempting to deal, and a careful reading of their works will bring these out. The move to higher and higher orders of abstraction started in the nineteenth century, and has reached its peak, apparently, in this one. (shrink)

The Dirac operator arises naturally on $\mathbb{S}^1 \times \mathbb{S}^3 $ from the connection on the Lie group U(1)×SU(2) and maps spacetime rays into rays in the Lie algebra. We construct both simple harmonic and pulse solutions to the neutrino equations on $\mathbb{S}^1 \times \mathbb{S}^3 $ , classified by helicity and holonomy, using this map. Helicity is interpreted as the internal part of the Noether charge that arises from translation invariance; it is topologically quantized in integral multiples of a constant g (...) that converts a Lie-algebra phase shift into an action. The fundamental unit of helicity is associated with a full twist in u(1)×su(2) phase per global lightlike cycle. If we pass to the projective space ℝP1xℝP3, we get half-integral helicity. (shrink)

A person's values are what that person regards as or thinks important; a society's values are what that society regards as important. A society's values are expressed in laws and legislatively enacted policies, in its mores, social habits, and positive morality. Any body's values—an individual person's or a society's—are subject to change, and in our time especially. An individual manifests his or her values in expressions of approval or disapproval, of admiration or disdain, by seeking or avoidance behaviour, and by (...) his or her characteristic activities. What one values one seeks for or tries to maintain. Sometimes attaining it leads to unexpected enlightenment—that isn't what one wanted after all. But a person's values are discovered most significantly in a reflective way by becoming aware of what one is willing to give up to attain or maintain one's values. This is the price one is willing to pay for it, and values are occasionally, and in the money and stock markets always, expressed in terms of price. This can be significant or it can be misleading; it depends on how it is interpreted. Not everything has a monetary equivalent, despite the attempts of the law to provide recovery for damages in monetary terms, and despite the cynical maxim, ‘Everyone has his price’. (shrink)

Cicero's essay On Friendship (Laelius de amicitia) is of interest as much for the light it sheds on Roman society as for its embodiment of ancient philosophical views on the subjects of friendship. The Dream of Scipio was excerpted in late antiquity from Cicero's De Republica, a dialogue in six books which now only survives in fragmentary form. In the excerpt, which probably formed the conclusion to the dialogue, Cicero describes his vision of the cosmos and the rewards of immortality (...) that the good statesman can expect after death. This work is particularly important for its influence on later literature in the Middle Ages and Renaissance.Both dialogues are examples of the best Ciceronian prose. They are presented in this volume in the context of Cicero's philosophical writing. Their place in ancient thought and their literary characteristics are discussed fully in the introduction, while individual points of interpretation are dealt with in the commentary. Oxidative damage to DNA appears to be a factor in cancer, yet explanations for why highly elevated levels of such lesions do not always result in cancer remain elusive. Much of the genome is non‐coding and lesions in these regions might be expected to have little biological effect, an inference supported by observations that there is preferential repair of coding sequences. RNA has an important coding function in protein synthesis, and yet the consequences of RNA oxidation are largely unknown. Some (...) non‐coding nucleic acid is functional, e.g. promoters, and damage to these sequences may well have biological consequences. Similarly, oxidative damage to DNA may promote microsatellite instability, inhibit methylation and accelerate telomere shortening. DNA repair appears pivotal to the maintenance of genome integrity, and genetic alterations in repair capacity, due to single nucleotide polymorphisms or mutation, may account for inter‐individual differences in cancer susceptibility. Cicero's On the Commonwealth and On the Laws were his first and most substantial attempts to adapt Greek theories of political life to the circumstances of the Roman Republic. They represent Cicero's understanding of government and remain his most important works of political philosophy. On the Commonwealth survives only in part, and On the Laws was never completed. The new edition of this volume has been revised throughout to take account of recent scholarship, and features a new introduction, a new (...) bibliography, a chronological table and a biographical index. James E. G. Zetzel offers a scholarly reconstruction of the fragments of On the Commonwealth and a masterly translation of both dialogues. Eli Hirsch recently suggested the metaontological doctrine of so-called "quantifier variance", according to which ontological disputes—e.g. concerning the question whether arbitrary, possibly scattered, mereological fusions exist, in the sense that these are recognised as objects proper in our ontology—can be defused as insubstantial. His proposal is that the meaning of the quanti er `there exists' varies in such debates: according to one opponent in this dispute, some existential statement claiming the existence of, e.g., a scattered object is true, according to (...) the other it is not. This paper argues that Hirsch's proposal leads into inconsistency. (shrink)

This article shows how the legacy of Hans Christian Ørsted (1777-1851), and his discovery of electromagnetism in 1820, was reconfigured and used by the H.C. english abstracts Ørsted Committee from 1914 before and during the centenary of 1920. Combining Somsen’s (2008) concept of olympic internationalism with uses of the past, I suggest understanding the 1920-centenary as an instance of olympic commemoration [olympisk historiebrug]. I argue that central actors from the committee, e.g. Martin Knudsen (1871-1949) and Kirstine Meyer, née Bjerrum (1861-1941), (...) used Ørsted's nationality to substantiate Denmark’s cultural and scientific achievements. By comparison to pre-twentieth century biographies, I show how the committee re-described Ørsted, i.e. from a scientist [Naturforsker] to being a Danish scientist [dansk Naturforsker]. The committee was deeply concerned with proving the big contributions by the small nation of Denmark, and I show how this relates to cultural politics of the early twentieth century Denmark. This paper shows that several live philosophical and scientific hypotheses – including the holographic principle and multiverse theory in quantum physics, and eternalism and mind-body dualism in philosophy – jointly imply an audacious new theory of free will. This new theory, "Libertarian Compatibilism", holds that the physical world is an eternally existing array of two-dimensional information – a vast number of possible pasts, presents, and futures – and the mind a nonphysical entity or set of properties that "read" that physical (...) information off to subjective conscious awareness (in much the same way that a song written on an ordinary compact-disc is only played when read by an outside medium, i.e. a CD-player). According to this theory, every possible physical “timeline” in the multiverse may be fully physically deterministic or physically-causally closed but each person’s consciousness still entirely free to choose, ex nihilo, outside of the physical order, which physically-closed timeline is experienced by conscious observers. Although Libertarian Compatibilism is admittedly fantastic, I show that it not only follows from several live scientific and philosophical hypotheses, I also show that it (A) is a far more explanatorily powerful model of quantum mechanics than more traditional interpretations (e.g. the Copenhagen, Everett, and Bohmian interpretations), (B) makes determinate, testable empirical predictions in quantum theory, and finally, (C) predicts and explains the very existence of a number of philosophical debates and positions in the philosophy of mind, time, personal identity, and free will. First, I show that whereas traditional interpretations of quantum mechanics are all philosophically problematic and roughly as ontologically “extravagant” as Libertarian Compatibilism – in that they all posit “unseen” processes – Libertarian Compatibilism is nearly identical in structure to the only working simulation that human beings have ever constructed capable of reproducing (and so explaining) every general feature of quantum mechanics we perceive: namely, massive-multiplayer-online-roleplaying videogames (or MMORPGs). Although I am not the first to suggest that our world is akin to a computer simulation, I show that existing MMORPGs (online simulations we have already created) actually reproduce every general feature of quantum mechanics within their simulated-world reference-frames. Second, I show that existing MMORPGs also replicate (and so explain) many philosophical problems we face in the philosophy of mind, time, personal identity, and free will – all while conforming to the Libertarian Compatibilist model of reality. -/- I conclude, as such, that as fantastic and metaphysically extravagant as Libertarian Compatibilism may initially seem, it may well be true. It explains a number of features of our reality that no other physical or metaphysical theory does. (shrink)

This chapter focuses on the psychological mechanisms behind the construction of preference, especially the actual processes used by humans when they make decisions in their everyday lives or in business situations. The chapter uses cognitive psychological techniques to break down these processes and set them in their social context. When attributes are compatible with the response scale, they are assigned greater weight because they are most easily mapped onto the response. For instance, when subjects are asked to set a price (...) for a gamble this task is compatible with the information about the gamble payoff, which is also expressed in monetary values (e.g., dollars). Conversely, when the task requires a choice the payoff information is not easily mapped onto the response anymore and loses some of its salience. In fact, Slovic, Griffin, and Tversky (1990) could show that using non-monetary outcomes attenuates preference reversals when no compatibility between the pricing task and the outcome attribute was possible. An assumption of the compatibility effect is that response modes compatible with specific characteristics of the options (e.g., payoffs) draw attention to them. One of the main themes that has emerged from behavioral decision research during the past decades is the view that people's preferences are often constructed—not merely revealed—in the process of elicitation (see e.g. Slovic). This conception is derived in part from studies demonstrating that normatively equivalent methods of elicitation often give rise to systematically different responses. These "preference reversals" violate the principle of procedure invariance fundamental to theories of rational choice and raise difficult questions about the nature of human values. If different elicitation procedures produce different orderings of options, how can preferences be defined and in what sense do they exist? Describing and explaining such failures of invariance will require choice models of far greater complexity than the traditional models -/- . (shrink)

This paper develops a non-relativist version of contextualism about knowledge. It is argued that a plausible contextualism must take into account three features of our practice of attributing knowledge: (1) knowledge-attributions follow a default-and-challenge pattern; (2) there are preconditions for a belief's enjoying the status of being justified by default (e.g. being orthodox); and (3) for an error-possibility to be a serious challenge, there has to be positive evidence that the possibility might be realized in the given situation. It is (...) argued that standard "semantic" versions of contextualism (e.g. those of Lewis, Cohen, DeRose) fail to take these features into account, which makes them overly hospitable to the sceptic, and that Williams' version of contextualism, although incorporating (1), fails to do justice to (2) and (3). According to the contextualism developed here, although epistemic standards vary with the context, the truth-value of particular knowledge-attributions does not. Contexts here are understood as being constituted by two elements: an epistemic practice (a rule-governed social practice such as a scientific discipline, the law, a craft etc., in which knowledge-claims are evaluated according to specific standards) and the "facts of the matter" (i.e. those facts which, together with the epistemic standards in question, determine which error-possibilities are relevant and thus have to be eliminated for a knowledge-claim to be true). If there are several epistemic practices, and thus several contexts, in which a knowledge-claim can be evaluated, it is the "strictest" practice that counts. In this way, the counterintuitive consequence of other versions of contextualism that the same knowledge-claim can be true in one context, but false in another, can be avoided. At the same time, scepticism can be resisted since even in the "strictest" epistemic practices, error-possibilities become relevant only when backed by positive evidence that they might in fact obtain. Several recent commentators argue that Thomas Hobbes’s account of the nature of science is conventionalist. Engaging in scientific practice on a conventionalist account is more a matter of making sure one connects one term to another properly rather than checking one’s claims, e.g., by experiment. In this paper, I argue that the conventionalist interpretation of Hobbesian science accords neither with Hobbes’s theoretical account in De corpore and Leviathan nor with Hobbes’s scientific practice in De homine and elsewhere. Closely tied to (...) the conventionalist interpretation is the deductivist interpretation, on which it is claimed that Hobbes believed sciences such as optics are deduced from geometry. I argue that Hobbesian science places simplest conceptions as the foundation for geometry and the sciences in which we use geometry, which provides strong evidence against both the conventionalist and deductivist interpretations. Even though Kant’s theory of cognition (Erkenntnis) is central to his Critique of Pure Reason, it has rarely been asked what exactly Kant means by the term “cognition”. Against the widespread assumption that cognition (in the most relevant sense of that term) can be identified with knowledge or if not, that knowledge is at least a species of cognition, we argue that the concepts of cognition and knowledge in Kant are not only distinct, but even disjunct. To show this, we (...) first (I) investigate Kant’s explicit characterizations of the nature of cognition. As it turns out, he introduces several different notions that must be carefully distinguished before identifying the one that is central to his project in the first Critique. We then (II) consider the basic features of Kant’s conception of knowledge, indicating both how it involves assent and objective justification and how it relates to our contemporary conception. Next (III), we compare and contrast Kant’s understanding of cognition and his conception of knowledge in a way that allows us to present their fundamental differences and connections. We argue that while cognition, in the most relevant sense, is a species of representation that differs from other representations in that it involves the conceptual determination of a sensibly given object, knowledge (for Kant) is a kind of assent to a judgment that requires consciousness of a sufficient epistemic ground. Finally (IV), by appreciating the differences between cognition and knowledge, we explain several of the implications this conception of cognition has for some of Kant’s main claims in the Critique of Pure Reason as a whole. Among other things, we show how Kant can deny cognition of specific things in themselves while allowing philosophical knowledge about things in themselves in general (e.g. that they exist, are not in space and time, etc.). The thesis of this article is that in Husserlian phenomenology there is no opposition between theory and praxis. On the contrary, he understands the former to serve the latter, so as to usher in a new world. The means for doing is the phenomenological reduction or epoché. It gives the phenomenologist access to the starting point, the “first things,” and orients his/her striving towards reason and the renewal of humanity. Careful attention to the significance of the epoché also sheds light (...) on Husserl’s understanding of the relationship of phenomenology not only to philosophy but also to the other sciences. Though an exposition of the “phenomenology of the philosophical vocation” which Husserl sketched in the 1920s, e.g., in his Kaizo articles and lectures on first philosophy, the author seeks to shore up his thesis. The Ideal of a Rational Morality collects the most important essays by the distinguished moral philosopher Marcus G. Singer. Its guiding theme is the concept of a morality based in reason, which is presupposed in ordinary moral contexts and provides an ideal for improving ordinary morality and correcting moral judgements. Singer makes compelling claims that certain fundamental presuppositions are inescapable in moral thought, that fundamental moral principles can be proved, and that the concepts of truth and 'common sense' are (...) essential to ethics.Subsequent essays proceed to analyse the nature of value judgements and of moral judgements, emphasising the vital importance of certain basic distinctions. `My present intention is to clear myself of any suspicion of partiality by presenting the views of the generality of philosophers concerning the nature of the gods.' Cicero's philosophical works are now exciting renewed interest, in part because he provides vital evidence of the views of the Greek philosophers of the Hellenistic age, and partly because of the light he casts on the intellectual life of first century Rome. The Nature of the Gods is a text of central significance, presenting (...) a detailed account of the theologies of the Epicureans and of the Stoics, together with the critical objections to these doctrines raised by the Academic school. “THE ONLY THING NECESSARY IS NOT THEORETICAL LEARNING, but the Bildung of human beings, both in regard to their talents and their character.” Kant’s epigrammatic observation in his 1778 letter to Christian Wolke, director of the Philanthropin, adumbrates not only his mature sense of “enlightenment” but also the pedagogical role of his critical philosophy and his own life’s work. Over a decade earlier, his reading of Rousseau’s Emile: or, On Education had “set him straight” about what constitutes the true dignity (...) of humanity, namely, that it did not consist in the advance of knowledge by scholarly inquiry as he had believed. The primary thing was, instead, the “restoration of the rights of humanity,” an objective articulated in Kant’s mature moral thought as that pedagogical method which facilitates the self-consciousness and efficacy of the moral law in the individual. In another 1778 letter, this time to his former student, Marcus Herz, Kant states that the “main purpose of his academic life,” which he “at all times keeps before him,” is to “cultivate good characters.” In both his lectures on anthropology and on pedagogy, Kant repeatedly emphasizes the need for education and, by extension, for attending to the education of the educator. Human beings are nothing save what education makes of them, but they can only be educated by other human beings who must themselves first be educated. As early as his 1775/ 76 anthropology lectures, Kant observes that “if teachers and priests were educated, if the concepts of pure morality would prevail among them, then... the whole could afterwards be educated.” The resulting task is clear: it is incumbent on every generation to work on the plan of a more purposive education,” a task Kant describes as the “greatest and most difficult problem that can be assigned to humankind.”.
